Privacy and Data Protection Policy

GUSANO FILMS S.A.S. (hereinafter, “Gusano Films”), in compliance with Law 1581 of 2012, Decree 1377 of 2013 and other regulations governing personal data protection in Colombia, adopts this Personal Data Processing Policy, applicable to data collected through the website www.gusano.org and the company’s other contact channels.

Data we process

Gusano Films processes the personal data voluntarily provided by the data subject through the website contact form (name, email address, telephone number and the content of the message), as well as professional contact details obtained in the course of its activity as an audiovisual production company.

Purposes of processing

Personal data is processed for the following purposes: responding to enquiries, requests and proposals sent through our contact channels; managing relationships with collaborators, partners, clients and suppliers; complying with legal and contractual obligations; and, where the data subject has given consent, sending information about Gusano Films’ activity and projects.

Rights of data subjects

In accordance with Article 8 of Law 1581 of 2012, data subjects have the right to: access, update and rectify their personal data; request proof of the consent given; be informed about how their data has been used; file complaints with the Superintendence of Industry and Commerce (SIC) for breaches of the law; withdraw consent and request the deletion of data where there is no legal or contractual duty preventing it; and access their personal data free of charge.

Contact channel and exercise of rights

To exercise their rights, data subjects may write to gusano@gusano.org, stating their name, the right they wish to exercise and the facts supporting their request.

Enquiries and complaints procedure

Enquiries will be answered within a maximum of ten (10) business days from receipt. Complaints will be handled within a maximum of fifteen (15) business days from the day after receipt, under the terms of Articles 14 and 15 of Law 1581 of 2012. If an enquiry or complaint is incomplete, the interested party will be asked to remedy the deficiencies within the following five (5) days.

Security and retention

Gusano Films adopts reasonable technical, human and administrative measures to protect personal data and prevent its alteration, loss, or unauthorised access or consultation. Data will be kept for as long as the purpose for which it was collected remains valid and for the periods required by law.

Supervisory authority

The authority responsible for personal data protection in Colombia is the Superintendence of Industry and Commerce (SIC), before which data subjects may file complaints once the procedure before the controller has been exhausted.

Validity

This policy takes effect upon its publication on the website and will remain in force for as long as Gusano Films carries out activities involving the processing of personal data. Any substantial change will be duly communicated through this same channel.
